The bill was signed into law in January 2011 and took effect inSeptember. While there was agreement that bullying should beaddressed, school officials expressed concerns about both time andcosts involved in requiring specially designated staff toinvestigate every potential incident of bullying. At a workshop ofschool administrators in October there were discussions aboutproposing modifications to the law.

The Council on Local Mandates was created pursuant to the StateMandate, State Pay amendment to the New Jersey Constitution. Underthe Constitution, if the council so rules, an unfunded mandateceases to be mandatory and expires.
The Anti-Bullying Bill of Rights is a well-intentioned statutedesigned to ensure that no child is ever afraid to go to schoolbecause of harassment or intimidation, Bilik said. Unfortunately,the legislation required more work prior to enactment, includingconsideration of the financial and staffing burdens placed on localschool districts.

The state maintained in its response to the complaint that aidprovided to school districts would cover the costs of the law andthat existing staff could fill the required anti-bullyingcoordinator and specialist positions.
Senate Majority Leader Loretta Weinberg, D-Bergen, anothersponsor of the law, said she will work on a revised version, butnoted that many districts have implemented the law with no problemsand she hoped those efforts would not be abandoned.
